Guidelines

The size of documents to be uploaded at the time of Application submission should not exceed 2 MB and format should be pdf/JPEG. No other format will be accepted.

Eligibility Criteria:

A pattadar or his/her legal heir or attorney holder or anyone having interest over the land.

Requirements
  1. Jamabandi Copy of the proposed Land.
  2. Identity Proof of the Applicant.
  3. Applicant must furnish complete details of the land including Dag No, Patta No, Village name etc.                                                                                

Stipulated Time Limit : Seven (7) working days.

Fees :

User Charge: Nil. Service charge (through PFC/CSC) – Rs. 30.

Printing charge (in case of any printing from PFC/CSC) – Rs. 10 per page.

Scanning charge (in case documents are scanned in PFC/CSC) – Rs. 5 per page.

How to correction land record?

Most State Government portals provide mechanisms for citizens to report discrepancies or errors in land records. This often involves submitting a request online or visiting the relevant land office.

Checklist:

  • Mutation is transfer or change of title from one person to another in the records of the local municipal body when property is sold or transferred.
  • Application for mutation can be addressed to the Branch officer, Mutation Branch, GMC in plain paper with clearly mentioning the assessment id,transferee name and other related information.
  • Duplicate Mutation certificate can be obtained by addressing an application to the Branch officer, Mutation Branch, GMC and providing the Case Number of the Mutation with payment of Rs. 100 (One Hundred Rupees) only , money Receipt at the Mutation Branch of GMC.

How to apply for land mutation online in Assam?

Overview

Mutation is the transfer or change of title ownership when property is sold or transferred. By mutation, the new owner gets the title of the property recorded on his/her name and the government is able to charge property tax from the rightful owner. Mutation can easily be done online in GMC.

All documents must be submitted while submitting the form. If filling online, all documents must be scanned and ready,

Documents Required (whichever applicable):

  • Upto date Property Tax paid receipt.
  • Self attested copy of Registered Sale Deed,Land Mutation order, Jamabandi & Patta etc.
  • Related documents of the concerned parties willing to undergo mutation.
  • Application on plain paper addressing to the Branch Officer, Mutation Branch, GMC.
  • Id proof of applicant(s)
  • Road/Lane where properties located (Mention in the application)
  • Receipt of Garbage collection from concerned N.G.O.
  • Death Certificate if property has devolved by succession from predecessor.
  • Next of Kin Certificate in case of mutation by inheritance.
  • Registered Will Documents, Registered Gift Deed if any
  • Authorisation Letter with photo ID (any) of the authorised person required in case the applicant is absent

How do you reclassify land in Assam?

In Assam, reclassifying land from agricultural to non-agricultural requires prior approval from the Deputy Commissioner under the Assam Agricultural Land (Regulation of Reclassification and Transfer for Non-Agricultural Purpose) Act, 2015. The process has been simplified through recent amendments to make it more efficient and citizen-friendly. Owners must pay a reclassification premium, with penalties for failing to establish an approved non-agricultural activity. 

Key regulations

  • Governing Act: The process is primarily regulated by the Assam Agricultural Land (Regulation of Reclassification and Transfer for Non-Agricultural Purpose) Act, 2015 and guided by Rule 23 of the Assam Land Records Rules, 1906. 
  • Deputy Commissioner Approval: Land recorded as agricultural can only be reclassified with the Deputy Commissioner’s prior approval. 
  • Recent Amendments: The Assam government has approved an amendment to simplify and streamline the reclassification process. 

Requirements and fees

  • Reclassification Premium: A premium is required, calculated as either 100% of the prevailing minimum zonal value or 15% of the prevailing minimum zonal value.
  • Non-Agricultural Activity: The reclassified land must be used for an approved non-agricultural purpose.
  • Penalties: Penalties, such as ten times the reclassification premium, can be imposed if the land is not used for the approved non-agricultural purpose. 

Land suitability

  • Suitable for Reclassification: Land that is no longer fit for agriculture for at least ten years, or agricultural land that has been under non-cultivation for ten years, can be considered for reclassification.

Key steps to correct mistakes: Identify the errors in the property document. Draft a Rectification Deed mentioning the corrections. Get it signed by both parties (buyer & seller). Pay the applicable stamp duty and registration charges.

  2. Correction Deed. A new deed reflecting the corrections/changes. Must meet all recording requirements of a deed.

What is Form 50 for land in Assam?

How to apply for other land-related services

  • For a Land Holding Certificate: You should use the standard application form (Annexure III) and provide supporting documents such as a land patta copy, address proof, and identity proof via Sewa Setu Assam. 
  • For land mutation: An application must be submitted to the Mutation Branch of the Guwahati Municipal Corporation, along with supporting documents like up-to-date property tax receipts, a copy of the registered sale deed, and mutation order via the Guwahati Municipal Corporation website.
